Overview

The Senior IP & License Enforcement Specialist supports ATCC's license enforcement process by reviewing internal and public data to verify external party compliance with ATCC's material transfer agreement, commercial use licenses, and trademark rights. This role maintains a docket of matters to document and regularly update management on the identification, investigation and resolution of issues impacting ATCC's rights and exposure to risk. The ideal candidate is adept in understanding problems of diverse scope in the intersection of intellectual property with contractual use restrictions on replicative materials and experienced at negotiating resolutions of adversarial matters that may lead to litigation.

 

The Senior IP & License Enforcement Specialist is responsible for conducting reviews of licensing files to ensure compliance with regulations and process. They conduct, document, and provide timely updates on complex enforcement investigations and license-related matters. They elevate high-level concerns to Senior Management which warrant additional consideration.

Responsibilities

  1. Receive information on complex compliance issues requiring investigation, investigate compliance matters, document findings, and present the case.
  2. Convey IP and license enforcement information to customers utilizing database and search functions. Process IP and license inquiries in a database. Routinely answer questions concerning the Material Transfer Agreement (MTA); the deposit, processing, and release of biological materials and information related to IP and licensing.
  3. Initiate licensing negotiations or other license-related matters. Educate on compliance regulations.
  4. Negotiate and draft patent licenses and other agreements.
  5. Initiate and process IP and license inquiries, conduct internal enforcement audits and investigations, process Rights checks, and facilitate the agreement execution process.
  6. Proactively review executed agreements for financial and reporting obligations, track licensee compliance with obligations and expiring agreements, and investigate MTA enforcement matters.
  7. Verify data entry and generate reports from multiple databases on pending and executed agreements, freedom-to-operate assessments, technology, financials, or other information supporting IP and licensing.
  8. Validate license documents for accuracy, completeness, and conformity to requirements.
  9. Qualify potential licensees and ensure that IP usage would be appropriate and in alignment with organizational messaging and strategy.

Qualifications

Education and Experience:

  • Bachelor's degree and 5 or more years' experience or equivalent experience.
